Abstract

This book explores the legal regime of non-product related process and production methods (NPR PPMs) in the context of trade-restrictive environmental measures, eco-labelling requirements and sanitary measures under the WTO. These issues serve as concrete, representative examples that raise broader questions about the legitimacy of the WTO dispute settlement system and help to explore the true position of WTO members in this complex legal regime. NPR PPMs are process and production methods that do not affect the product as such, meaning that there is no discernible difference in two products with different NPR PPMs. This work examines WTO states’ attempts to regulate in this regard and create product distinctions on the basis of NPR PPMs. To do so, it scrutinizes historical, institutional, substantive and case-law issues related to NPR PPMs, environmental policy and the WTO. Further, the book addresses the issues of legitimacy, regulatory space and reform, contributing to the lively debate on the future of the WTO.

Abstract

Er wordt stilgestaan bij de organisatie van het milieubeleid, de rechtsbronnen, de rechts bescherming, alsook de besluitvorming in het milieubeleid. Nadien wordt een overzicht geboden van het materieel milieurecht in het Vlaamse Gewest. Abstract

This book investigates pesticide compliance in China in order to provide a more comprehensive understanding of compliance and offers some feasible and adaptable suggestions for enhancing the effectiveness of this compliance. It discusses the weak implementation of Chinese laws and rules and emphasizes the necessity and importance of a compliance perspective in China that focuses on why laws are obeyed or broken. It examines how vegetable farmers’ perceptions of amoral calculation affect their pesticide compliance behavior and analyzes how the legitimacy of law is related to compliance to better explain how all the variables interact to shape compliance. It discusses both qualitative and quantitative methods, and uses a large-N qualitative approach, which allows for systematic analysis and in-depth exploration. This book will help readers to understand compliance in developing China by adopting and developing compliance theories which are broadly developed in the West.

Abstract

This book focuses on how to create an environmentally friendly society in China from the viewpoint of environmental law and policy. The authors accessed a great number of valuable sources not available in English, and interviewed various scholars and public officials, in order to analyze the environmental policies in China while comparing some of the features to Japan. The book stresses the importance of introducing a brand-new policy of central and local government, and analyses why these policies have not been executed effectively in the local society. In addition to the economy-oriented policy and spirit of the Chinese nation, which are the main causes, this book also highlights shortcomings in the inspection system, information management, and the extremely low degree of public participation as important aspects to focus on in order to tackle the current problems. The individual chapters will help readers to understand the environmental issues in China in depth, and provide guidance on resolving the issues in China and in developing countries that are now or soon will be facing the challenge of combining economic growth and environmental improvement. Abstract

The environmental impacts of climate change represent challenges to the societies and are anticipated to contribute to the destabilization of their human security, endangering ways of life of human-beings and inducing conflicts. Vulnerable societies are likely to see a surge in conflicts and violence happen. However social, economic and political circumstances mediating environmental changes are fundamental and determine whether the societal challenge will be a conflictive one. In Western Africa, major environmental changes are expected and the region hosts especially vulnerable population groups (i.e. herders and farmers). Political factors might contribute to determining the occurrence, escalation or reduction of conflict between those groups. The influence of integration policies, of the fairness of land tenure, and of decentralization and participation possibilities on conflicts is studied in Côte d’Ivoire, Ghana and Burkina Faso.

Abstract

This book looks at how the multiplicity of formal and informal normative systems that administer the post-disaster recovery objectives of the Philippine Disaster Risk Reduction and Management Act of 2010 has resulted in inadequate housing and relocation as well as greater suffering to typhoon victims. Using the sociological and normative pluralist perspectives and the case study method, it evaluates the level of conformity of the government resettlement program given to Typhoon Ketsana victims to the legal standards. It highlights the complex and competing legal and cultural normative regimes of various stakeholders and public agencies, rigid regulation in the state’s real estate bureaucracy and the unscrupulous involvement of some powerful and ‘corrupt’ real estate developers and housing groups, as largely contributing to the project’s significant deviation from the law’s proactive rehabilitation goals. It aims to promote the sociological and socio-legal frameworks in post-disaster research and invites policymakers to enact a comprehensive post-disaster management law and create a one-stop disaster management agency to minimize the negative unintended effects caused by normative pluralism in post-disaster resettlement projects.

Abstract

This book is an attempt to acknowledge the discipline ‘wetland science’ and to consolidate research findings, reviews and synthesis articles on different aspects of the wetlands in South Asia. The book presents 30 chapters by an international mix of experts in the field, who highlight and discuss diverse issues concerning wetlands in South Asia as case studies. The chapters are divided into different themes that represent broad issues of concern in a systematic manner keeping in mind students, researchers and general readers at large. The book introduces readers to the basics and theory of wetland science, supplemented by case studies and examples from the region. It also offers a valuable resource for graduate students and researchers in allied fields such as environmental studies, limnology, wildlife biology, aquatic biology, marine biology, and landscape ecology. To date the interdisciplinary field ‘wetland science’ is still rarely treated as a distinct discipline in its own right. Further, courses on wetland science aren’t taught at any of the world’s most prestigious universities; instead, the topics falling under this discipline are generally handled under the disciplines ‘ecology’ or under the extremely broad heading of ‘environmental studies’. It is high time that ‘Wetland Science’ be acknowledged as an interdisciplinary sub-discipline, which calls for an attempt to consolidate its various subtopics and present them comprehensively. Thus, this book also serves as a reference base on wetlands and facilitates further discussions on specific issues involved in safeguarding a sustainable future for the wetland habitats of this region.

Abstract

This book considers all aspects of bioprospecting in 14 succinct chapters and a forward by David Hawksworth. The organisms addressed include plants, insects, fungi, bacteria and phages. Bioprospecting has never been more relevant and is of renewed interest, because of the extremely worrying rise in novel, resistant pathogenic microorganisms. The practices in pharmaceutical companies have failed to deliver novel antibiotics to control these infections. We need to look for new sources of drugs from the environment on a massive scale as drug discovery is “too important to fail”. Furthermore, the field can add great value to ecosystems in terms of economics, while providing additional reasons for maintaining associated services, such as food provision, benign climate, effective nutrient cycling and cultural practices. Bioprospecting provides another reason why climate change must be reduced in order to preserve relevant environments. Previous bioprospecting projects should be re-visited and established biodiversity centres have a major role. Many different ecosystems exist which contain unique organisms with the potential to supply novel antibiotics, enzymes, food, and cosmetics, or they may simply have aesthetic value. The book stresses the difficulties in obtaining successful products and yet describes why natural products should be investigated over combinatorial chemistry. Personal experience of bioprospecting projects are given significance. Issues such as how to share the benefits equitably with local communities are described and why pharmaceutical companies can be reluctant to be involved. Legal issues are discussed. Finally, there has never been a better time for a new book on bioprospecting, because of the need to preserve ecosystems, and from the emergence of resistant pathogenic microorganisms.

Abstract

This book summarizes assessments of the Paris Agreement to provide an excellent introduction to this research field. The AIM/CGE (Asia-Pacific Integrated Modeling /Computable General Equilibrium) model, which is the core of AIM modeling framework, is used for the assessment. The first part focuses on global issues, presenting both short-term (a few decades) and long-term (century scale) assessments in the context of the Agreement’s ultimate climate goal. It also discusses policy implementation and climate risk. Part 2 is a collection of assessments of individual Asian countries, providing insights into the national situations and detailed analyses. It includes contributions from Asian countries as well as NIES (National Institute for Environmental Studies, Japan) members. The main conclusion is that many countries require changes to their energy systems change and societal transformation in order to meet emissions targets. Part 3 describes in detail the AIM/CGE model, which is used to evaluate the climate and energy policies by simulating the future economic and energy and environmental situation in the Asia-Pacific region. This section can be used as a standard text on CGE modelling in climate change mitigation.
